Scope: These Terms govern your access to and use of Montlore’s website, online store, and related features, content, tools, products, and services (collectively, the “Services”). The Services are operated by Montlore and powered by Shopify’s commerce infrastructure.
Your Agreement: By accessing, using, or placing an order through the Services, you agree to be bound by these Terms and our Privacy Policy and Return/Refund Policy (together, the “Supporting Policies”). If you do not agree, please do not use the Services.

1. Accounts & Access

You represent that you are of legal age in your jurisdiction and are responsible for all activity under your account. You will provide and keep current, complete, and accurate contact, shipping, billing, and payment information. Accounts are personal and non-transferable; you are responsible for safeguarding your credentials.

2. Products & Content

We strive to display products accurately, but due to device/display differences, color and appearance may vary—final goods prevail. Except where required by law, we do not warrant that products/services will meet subjective expectations or precisely match on-screen renderings. We may update descriptions, discontinue items, or limit quantities without notice.

3. Orders: Offer, Acceptance & Cancellation

Your order is an offer to purchase and is accepted only when confirmed by us (typically upon processed payment and an “confirmed/shipped” status). We may refuse or cancel any order for any reason (including inventory, obvious errors, risk controls, or abnormal shipping details). For obvious errors (e.g., manifestly incorrect prices/promotions/stock), we may correct or cancel prior to shipment and refund you. Purchases are for personal/household use only, not for resale or export. Once accepted, orders may be difficult to change or cancel—contact support promptly if needed.

4. Prices, Taxes & Billing

Prices, discounts, and promotions may change at any time; the price in effect at order time applies. Unless expressly stated, prices exclude taxes, shipping, handling, duties, and import charges. You confirm you are authorized to use the selected payment method and will pay all amounts due. If promotion terms conflict with these Terms, the promotion terms prevail.

5. Shipping, Risk & Title

Delivery times are estimates only. We are not liable for delays caused by carriers, customs, or events beyond our control. Risk of loss and damage passes to you when goods are handed to the carrier (unless otherwise required by law or agreed in writing). Inspect packages upon receipt and follow our Return/Refund Policy timelines for issues.

6. Third-Party Tools & Links

The Services may include third-party tools, content, or links. We do not control or endorse third parties and make no warranties about their availability, accuracy, security, or compliance. Use of third-party tools/services is at your discretion and risk; review their terms and policies first.

7. Intellectual Property

All content and materials in the Services are owned by Montlore or its licensors. Subject to these Terms, we grant you a personal, non-exclusive, non-transferable, revocable license to use the Services for non-commercial purposes. You may not reproduce, modify, republish, or create derivative works without written permission. Montlore names, logos, and marks are our trademarks; Shopify and other marks belong to their respective owners.

8. User Content & Feedback

By submitting reviews, ideas, or suggestions (“Feedback”), you grant Montlore a perpetual, worldwide, sublicensable, royalty-free license to use, reproduce, adapt, publish, and display such Feedback for operating and improving the Services and for legitimate commercial purposes. You represent you hold necessary rights and will disclose any incentives received. We may remove unlawful or inappropriate content at our discretion.

9. Prohibited Conduct

You will not: violate laws or third-party rights; interfere with or compromise the Services or their security; upload malware; scrape or harvest data; mislead, abuse promotions, or commercially exploit the Services; or harass, defame, or threaten others. We may suspend or terminate access for violations at any time.

10. Privacy & Data

Your personal information is governed by our Privacy Policy (https://montlore.shop/policies/privacy-policy). Because the Services are hosted by Shopify, Shopify and its partners may process and transfer personal data to provide the Services. See our Privacy Policy and Shopify’s posted policies for details.

11. Returns & After-Sales

Returns, ineligible items, RMA flow, and refund timelines are governed by our Return/Refund Policy (https://montlore.shop/policies/refund-policy). If these Terms conflict with that policy, the Return/Refund Policy controls.

12. Disclaimers 

The Services, all content, and products are provided “as is” and “as available” without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, non-infringement, availability, error-free or uninterrupted operation. We are not responsible for third-party tools/links/content. Nothing here limits your non-waivable consumer rights under applicable law.

13. Limitation of Liability 

To the maximum extent permitted, in no event shall Montlore or its affiliates, officers, employees, agents, service providers, or licensors be liable for indirect, incidental, special, punitive, or consequential damages (including lost profits/revenue/data, goodwill, or replacement costs), even if advised of the possibility. In all cases, our aggregate liability arising out of or related to the Services or products shall not exceed the total amount you paid to Montlore for the order directly giving rise to the claim in the twelve (12) months preceding the event. These limits do not apply where prohibited by law.

14. Indemnification

You agree to defend, indemnify, and hold harmless Montlore, Shopify, and their respective affiliates, officers, employees, agents, service providers, and licensors from claims, damages, liabilities, and expenses (including reasonable attorneys’ fees) arising out of your violation of these Terms, laws, or third-party rights, or your misuse of the Services.

15. Force Majeure

We are not liable for delays or failures due to events beyond our reasonable control, including natural disasters, governmental actions, wars, epidemics, strikes, supply-chain or platform outages, network failures, customs restrictions, or import/export constraints. We will use reasonable efforts to resume Services.

16. Governing Law & Venue 

These Terms of Service and any separate agreements whereby we provide you Services are governed by and construed in accordance with the federal and state or territorial laws in the jurisdiction where Montlore is headquartered. You and Montlore consent to venue and personal jurisdiction in the courts of that jurisdiction.

17. Changes, Assignment & Notices

We may update these Terms by posting a revised version on this page; unless required by law to provide additional notice, updates are effective upon posting. Continued use constitutes acceptance. We may assign or delegate our rights and obligations hereunder; you may not assign without our written consent. We may provide notices via website postings or email; notice is deemed given upon sending or posting.

18. Miscellaneous

If any provision is unenforceable, the remainder remains in effect. No failure to enforce is a waiver. These Terms and the Supporting Policies are the entire agreement and supersede prior understandings. If multiple language versions exist, the English version controls to the extent permitted by law.
